What change in pensions will occur on 7.11. Pension reform in Russia

As a general rule, the increase in payments provided to pensioners is carried out as planned. The construction of such plans is entrusted to the Government. At the end of 2015, another law was adopted at the federal level (No. 385), which fixed at the state level the absence of planned increases in pension provision. This rule applies only to pensioners who have not stopped their labor activity.

Although the legal act was adopted at the end of 2015, it established the rules governing relations that arise in the future. This law will remain in effect until at least 2018.

The situation that has developed in the legal field is quite unpleasant for pensioners who have decided to continue working in the general manner.

The reason for such an unpleasant move on the part of the legislator is the desire to reduce the burden on the state treasury. The economic situation in the country is quite difficult and requires some restrictions in spending available funds.

The provisions of these legislative changes relate to the indexation of those savings that are classified as insurance pensions. Their indexing should be carried out depending on the annual indicators demonstrating the inflationary level.

Do not forget that the calculation of pension accruals for persons retiring will be carried out using indexing indicators. Such calculation will be performed from the moment of termination of performance of labor functions. Until this moment, the pensioner cannot count on additional compensation that is not determined by the current norms of lawmaking acts.

Payments that pensioners related to employers by labor relations can receive

This year, every pensioner who is paid a social pension by the state has the right to receive a lump-sum payment. The amount of such additional payment will be 5000.00 rubles.

The payment was made together with the accrual and provision of the pension for January. All citizens who received the status of a pensioner before the end of 2016 have the right to receive funds.

The issue of charging additional payments was considered and resolved by government forces back in August. In fact, such a payment is a replacement for the previously carried out indexation, which was intended for those pensioners who receive an age pension. The indexing provisions did not apply to pensioners in formal employment. The high level of burden on the budget of our country, at present, does not allow government forces to make decisions on a more significant level of indexing.

The planned payment to all pensioners of the country becomes the reason for finding additional funds in the amount of more than 200 billion rubles. In the event that indexing took place in full, established by previously existing acts of legislation, 550 billion rubles would have been spent on its implementation. more.

It cannot be said that such actions of the Government are entirely positive. It should be noted that such a one-time payment received by pensioners in the current year cannot be accepted for the calculation of subsequent indexation.

Cash equivalents of allowances

The previously demonstrated system of accrual of payments that are provided to pensioners will operate over the next few years. Changes in such a system can and will be due solely to a change in the legal norms governing actions in the field of pension legislation. The most significant such changes will be for those pensioners who do not intend to stop working.

It is important to note that no legislative changes on this issue will cause a change in the procedure for calculating social benefits. As legislators assure, socially unprotected categories of citizens will continue to receive their payments, taking into account the percentage of indexation.

The complexity in the Russian economic sector will not be able to have an irreversible impact on pension provision. The government still finds funds to increase pension payments and implements them in the manner prescribed by law

By tradition, the recalculation of pension payments will take place in August this year. Such a recalculation is intended to bring the calculation of pensions into line, taking into account the changes that have occurred in the funded pension system.

The points earned by the pensioner over the past year will be taken into account and will increase the insurance part of the payment. The maximum number of points can reach three.

Already today, one individual score is equal to 78.58 rubles. The score accumulated over the past year is 74.27 rubles. The value of the score increases every year.

For those citizens who, although they are entitled to receive pension payments, but do not use it, the increase coefficient will be preserved.

In such situations, it will not matter what intentions a citizen has: whether he wants to continue his labor activity or simply is not in a hurry with the registration procedure.

Each such year of waiting is called a grace year. These time periods make it possible to increase the fixed and insurance component of the pension payment. Postponing the pension payment for 10 years will result in an increase in the insurance part of the pension by 2.32 times, and the fixed part - by 2.11 times.

Registration of surcharges

Employees who are of retirement age and have decided to leave have the opportunity to exercise their right to receive pension payments. For this purpose, a citizen must apply with personal documents to the PF department operating at his place of residence or at the MFC. Currently, it is possible to apply for a pension through electronic procedures.

When applying, you will need to:

  • complete the single application form. A sample of such a document is available both in each branch of the PF, and on the official page of the PF;
  • present a civil passport that allows the identification of the applicant;
  • provide documents confirming the fact of termination of the person's labor activity. Mandatory presentation is a work book.

In some individual cases, PF employees may require other documentation. That is why, information about the required package of documents must be obtained individually. Obtaining an individual consultation from a PF employee will allow the applicant to avoid repeated visits to the state body and the loss of his own time in queues.

A citizen has the opportunity to present documents until the last day of May this year. Already from the first day of summer, the PF will collect such information automatically.

Upon receipt of the necessary data, the PF employees will perform the necessary calculations. It is worth presenting documents only to those pensioners who received such status in the period from 10/01/15 to 03/31/16. The rule remains relevant as of 2018.

Feature of the recalculation carried out in August

Persons who have reached the age of receiving pensions, but who have continued their labor duties under an employment contract, may not apply to the Pension Fund authorities for the purpose of recalculation. Such actions will be carried out by PF employees automatically. Thus, the application of the pensioner is not even required for the recalculation.

The recalculation that takes place in August is carried out taking into account the points that were accumulated last year. The maximum increase in pensions for employed persons may be 235 rubles, which will be equal to three points.

A citizen has the opportunity to receive 8.26 points in 2018, affecting the increase in his pension.

The foregoing in this article indicates that the largest part of pensioners who continue their employment relationship can expect to receive a recalculation in relation to the full amount of their own earnings.

The issue of increasing the amount of payments is one of the main both for the pensioners themselves and for the government as part of its implementation of the Strategy for the long-term development of the pension system. This issue is becoming especially relevant at the moment due to the growth of the consumer price index, and, consequently, rising inflation and instability in the social sphere.

In the latter option, the sum insured can be increased due to unaccounted payments:

  • when assigning one of the types of insurance payment;
  • when transferring from one to another;
  • or at the previous recalculation.

Recalculation of pensions for working pensioners

For working recipients of pension payments, this is a change in the size of the pension in connection with the continuation of labor activity, and hence the continuation of the transfer of insurance premiums by the employer to the Pension Fund. Such an increase is carried out annually on August 1 on an unannounced basis and, in fact, is an adjustment, since depends on salary particular pensioner.

For the first time recalculation under the new rules of the law "About insurance pensions" was made from August 1, 2016, taking into account insurance premiums for the full previous year.

The amount of the payment is now increased by the value of pension points (PPI). Moreover, the maximum value of the IPC, taken into account in such a recalculation, is established by law:

  • no more than 3.0- for citizens who do not form pension savings in a given year;
  • no more than 1,875 - for citizens transferring funds for a funded pension.

The recalculation of payments to working pensioners is carried out on the basis of Art. 18 law "About insurance pensions". Increase amount and the increased amount of the pension can be determined by the formula:

SP 2 = SP 1 + (IPK x SPK),

  • SP 2- the amount of insurance payment after recalculation,
  • SP 1- the amount of the insurance payment before the increase,
  • IPK- individual coefficient on January 1 of the year in which the increase is made,
  • SPK- the value of the pension coefficient as of the day from which the recalculation is carried out.

Petr Ivanovich receives an old-age insurance pension and continues to work. From August 1, 2018, he is entitled to recalculation, taking into account the accumulated points for 2017. Last year, Petr Ivanovich's average monthly salary was 15,000 rubles. Therefore, the annual salary: 15,000 x 12 = 180,000 rubles.

The contribution rate for the insurance payment is 16%, because funded pension is not formed. Payments for the insurance pension transferred for the year: 180,000 x 0.16 \u003d 28,800 rubles.

To convert this amount into points, it is necessary to divide it by the amount of annual contributions from the maximum salary in 2017 (876,000 x 0.16 \u003d 140,160 rubles):

  • 28800 rubles / 140160 rubles x 10 = 2.055 points.

The cost of 1 point in 2018 is 81 rubles 49 kopecks. Petr Ivanovich's pension at the moment is 10 thousand rubles.

Having all the above data, we calculate the amount of the payment after the future adjustment on August 1, 2018:

  • 10,000 + (2.055 x 81.49) \u003d 10,000 + 167.46 \u003d 10167.46 rubles.

Thus, the size of the increase in the pension of Petr Ivanovich will be 167.46 rubles, and the amount of the payment will be 10,167.46 rubles.

Recalculation of the funded part of the pension

This type of recalculation is carried out on the basis of Art. 8 Laws "About funded pension" August 1st annually in an informal manner for citizens receiving funded or urgent pension payments.

An increase in the amount of payments for this type of pension is possible in the following cases:

  • income from investment pension savings;
  • receipt of payments not included in the appointment this part of the pension (for example, if the citizen continues to participate in the state co-financing program).

In fact, this change in the funded pension payment is an adjustment and is of an individual nature, since it depends on the contributions received to the personal account.

Recalculation of pensions for women for children

After the pension reform, since 2015, when calculating a pension, not only the time of work, but also other periods counted in the insurance period (non-insurance) began to be taken into account. One of them is the child care period, for which 1.8 pension points are awarded for a full year of care.

Before the pension reform, such periods did not affect the size of the pension, but now women have the opportunity to spend, receiving an increase in their pension. Such a recalculation is carried out in a declarative manner, i.e. an application of the established form is submitted to the Pension Fund of the Russian Federation.

However, often in order to obtain the right to account for pension points for periods of childcare, it is necessary to partially waive the previously assigned pension and apply to the FIU with an application for the appointment of a new one, in which the option of such a replacement will be taken into account. At the same time, when recalculating points, the length of service may be reduced.

Recalculation when a pensioner reaches 80 years

In this case, it happens increase in the amount of the fixed payment. For citizens who are over 80 years old, the increase is carried out in a double amount automatically, taking into account the passport data available in the payment file.

It should be remembered that the right to receive a second basic payment upon reaching the age of 80 can be exercised by only beneficiaries.

  • Citizens receiving a survivor's benefit must switch to an old-age insurance pension in order to acquire the right to a double fixed payment, for which they must submit an appropriate application to the FIU.
  • Retirees receiving are also not eligible for double the base amount.

Pension upon change of disability group

When changing a disability group from one to another, recalculation of the amount of payment is made without application from the date of establishment of another group. The basis for such a recalculation is the certificate of examination sent by the bodies of medical and social expertise to the territorial body of the PFR at the place of registration of the pensioner.

It is worth noting that an increase in a fixed amount when a disability group changes is also related to the insurance payment for old age and disability. For disabled citizens of group I, a fixed payment is made in double size.

Application to the Pension Fund for the recalculation of pension

A citizen receiving a pension payment has the right to apply for a change in the amount paid in the event of a change in circumstances affecting its size.

  • change in the number of dependents;
  • change of residence to the Far North or an area equated to it;
  • acquisition of the right to an early retirement in connection with the length of service worked in the Far North;
  • change in the category of the recipient of the insurance payment for the loss of the breadwinner in connection with the loss of the second parent;
  • moving from the countryside to another place of residence.

Grounds for implementation recalculation of insurance pension are:

  • change in the number of points accumulated for the previous year;
  • change in the amount of pension coefficients.

You can apply for the recalculation of a pension in person or through a representative by contacting the PFR department at the location of the pension case, through a multifunctional center, a post office or a personal account on the PFR website.

The application must have the following information:

  • information contained in the citizen's passport;
  • the reason that is the basis for the recalculation;
  • list of attached documents.

To complete the application, you will need: a passport and SNILS, other documents can be requested from the applicant only if they are not available in state bodies. This rule is regulated by the Law on the provision of public services No. 210-FZ of July 27, 2010.

Written appeal is considered within five working days from the date of receipt with all necessary documents, or from the day of receipt of the last missing document.

When does the pension adjustment take place?

Change in the amount of the paid pension in an informal manner takes place annually on August 1st. Such adjustment of pension payments is carried out:

  1. taking into account the received payments for the insurance pension;
  2. taking into account the payments received for the funded pension.

The reason for this change is the increase in the amount of the pension coefficient for the previous year.

Other increases in the amount of cash are carried out:

  • from the 1st day of the next month after a change in circumstances, reducing the amount payments;
  • from the 1st day of the next month after the receipt of the application for recalculation upward payments.

However, there are special cases regarding the date of occurrence of the right to recalculation:

  • at reaching the age of 80- from the date of reaching the specified age;
  • at change of disability group- from the day the disability was established (except in cases of assigning a group that entails a downward recalculation, then the change in the amount will occur from the next month).

Conclusion

The recalculation of the pension payment is due to recipients in Russia. The change in the amount occurs either on the basis of documents already available in the pension case, or in connection with the submission by the citizen of new documents or the emergence of new circumstances.

In contrast to the recalculation is more individual character for a pensioner, since it takes into account the characteristics of each individual at a certain point in time, for example, reaching the age of 80, changing the number of dependents, changing the disability group.

However, there are recalculations made en masse, for example, concerning, to whose personal accounts employers' insurance premiums continue to be received. In addition, additional payments may also be received on, in connection with which a new type of recalculation was introduced relatively recently, taking into account such contributions.

The unstable economic situation in the country, which has persisted for more than a year, has a significant impact on pensioners. Next year they will have many interesting changes that will help improve their standard of living.

In particular, this concerns the increase in the retirement age and other points that will occur in the process of reforming the pension system.

What will working pensioners get in 2019

The most sensational change that will happen to pensioners in the coming year is the increase in the retirement age, which allows you to apply for an insurance pension. According to the authorities, this measure will help improve the labor market, where there is a shortage of workers and reduce the burden on the country's economy, because every year the number of pensioners who are difficult to maintain is increasing.

Starting next year, the law on the procedure for assigning pension payments will come into force. It was said above that next year there will be an increase in the retirement age, but at the same time, the authorities are going to increase the size of the pension.

Recently, the issue of indexation of pensions has been of concern to everyone, not only the current pensioner, but also people of pre-retirement age.


Carrying out indexation and recalculation of pensions according to the new rules

In recent years, indexation of pensions was carried out on the amount of inflation of the past year. In this case, the increase in money was within 5%. The new law adopted a new method of indexing.

According to the new law, the pension increase will be increased. This is the first time that the increase will exceed the expected rate of inflation. The authorities of the country noted that the size of the increase would be 1,000 rubles.

In 2016, with an inflation rate of 12.9%, the increase in the insurance pension was only 4%. In January 2017, all pensioners received a one-time payment of 5 thousand rubles, which compensated for the partial indexation of the previous 12 months.

For each pensioner, the amount of the increase will be set individually. If the size of his pension is large, then the increase will also be large.

Pension indexation schedule

It is worth recalling that the recalculation of the pension took place once a year - in February. The increase in pension payments took place in April. According to the new resolution, the procedure for increasing benefits will be as follows:

  • once a year the size of the pension will increase;
  • The recalculation date will be January 1st.

This schedule was approved by the authorities for 6 years ahead. Thus, the first indexation of the pension will be made from January 2019. It turns out that pensioners will receive an increase a month earlier than usual.

The increase in pension payments from February 1 was justified by the fact that the Federal State Statistics Service publishes information on price increases for the previous month only at the beginning of the next month. As for the annual inflation rate, it is already known in the last days of December, and in the first days of January it is only being specified. According to the experience of past years, the December and January data are completely the same. Therefore, it is quite acceptable to index pensions at the beginning of each financial year, that is, from January 1.

Until the beginning of 2015, the appointment, execution and procedure for paying labor pensions to Russians was regulated by the articles of Law No. 173-FZ. Today, it has only some rules that regulate the determination of the size of the labor insurance pension, and do not contradict the new version of the law.

The new law No. 400-FZ "On insurance pensions" entered into force at the beginning of this year, and some articles (14, 15, 17) - only next year.

New provisions of the law

Articles 1 to 7 describe the general provisions for the appointment of labor pensions, their types, possible recipients, retirement. Articles regulate the following issues:

  • As a protection for Russians of retirement age, the state provides for the appointment and corresponding payment of pensions (the Constitution and Law No. 167-FZ).
  • In the field of insurance pensions, the norms of Russian and international legislation apply.
  • Article 3 deciphers the concepts of insurance experience, pension, pension coefficient and others.
  • The persons who can apply for a pension and the types of payments are also indicated.

The conditions for the payment of a pension are determined by articles 8-10 (2nd chapter). All three types of payment are described - for old age, loss of a breadwinner or after receiving a disability. The entire 3rd chapter is devoted to length of service: the time of work, which may be included in its composition, periods outside of work, which are also taken into account in the length of service, the method of determination and confirmation.

The fourth chapter normalizes the determination of the size of the pension and reveals the concept of a fixed payment. So, in addition to the actual calculation scheme, there are options for increasing the fixed part, recalculating the size. Separately, articles 19-20 describe the concept of the share of the old-age insurance pension for special categories of recipients: civil servants and flight test personnel.

Articles in Chapter 5 describe the procedure for appointment, terms of appointment / recalculation, methods of payment or delivery, possible deductions from the pension. Article 27 of the new law on labor pensions describes the procedure for paying citizens who retain their rights to preferential pensions.

Chapter 6 describes the nuances of assigning preferential (early) pensions for flight personnel, persons who have worked for a certain number of years in the Far North or hazardous industries, as well as transitional provisions. The final 7th chapter contains a list of transitional provisions and the entry into force of this law.

Major changes

In addition to Law No. 400-FZ, another important document came into force - Law No. 424-FZ on the funded part of the pension. The articles of these two laws introduced some changes in the procedure for calculating the labor pension of Russians. The main one is the abolition of the actual term "labor pension". From the current year, the pension will be divided into 2 parts, absolutely independent - funded and insurance.

Changes in 2015:

  • Increasing the minimum insurance period required to process the payment. If earlier it was enough to have an experience of 5 years (insurance), now this figure has increased to 6 years. Moreover, the minimum will increase annually by 12 months until it reaches the bar of 15 years by 2025. Article 3 of the new law speaks about the need to increase the length of service in order to receive an old-age pension.
  • There have been changes in terms of pension coefficients. So, from January 1, an old-age pension can only be issued if the individual score of the recipient is 6.6 (with an increase of 2.4 every year). IPC (individual coefficient) is an innovation of this year. The formula for calculating it is not simple, but the size will always be directly dependent on the salary of the future pensioner, the length of service and the date of vacation.
  • Now the period during which a pension is issued is not included in the length of service.
  • There is news for families with many children - Article 12 establishes their right to offset the length of service during the inspection period for a child for one and a half years and no more than 6 (and earlier 4 years) for all children.

The retirement age has remained the same - 60/55 years, with the exception of preferential pensions. For example, the rights of health workers remain the same: they can take early vacation if they meet the requirements: 30 (25) years of experience in the field of medicine, a coefficient of at least 30.

The retirement age is set by Article 27 of the federal law on labor pensions:

  • hot or underground experience involves the early appointment of payments from the age of a citizen 50/45 (men / women);
  • difficult working conditions - 55/50 years, if the special experience exceeds or equals 12.6/10 years;
  • 50 years for women - work in the textile industry for 20 years or in some jobs in agriculture for 15 years and so on.

Article 28 of the Law on Labor Pensions defines other categories of pensioners who can count on early payment:

  • women with 5 or more children, and raising each of them at least up to 8 years;
  • disabled people after a military injury - 55/50 years;
  • employees of the Far North (at least 15 years of experience) - 55/50 years;
  • visually impaired (first group) - 50/40 years (experience - 15/10 years).

The new procedure for assigning payments is designed to reduce the “equalization” in the process of processing payments. Now, a larger pension will be received by those workers who, during the period of employment, received “white” wages, have a long service (instead of the previous 5 minimum years).

Starting from the new year, 4 main factors will affect the size of the pension: the amount of salary, the amount of contributions paid, the time of going on vacation and the availability of general and special experience.
